By accessing or using the PayPosts platform ("Platform"), available at payposts.paywallo.com.br, you ("User") represent that you have read, understood, and fully agree to these Terms of Service ("Terms"). If you do not agree with any provision of these Terms, do not use the Platform.

Continued use of the Platform after any updates to these Terms constitutes acceptance of the changes. Whenever there are material changes, we will notify you by email or through a notice on the Platform itself.

3. Registration and User Account

3.1. To use the Platform, the User must create an account by providing a valid email address and a password.

3.2. The User is fully responsible for the accuracy of the information provided during registration and for the security of their access credentials. PayPosts is not liable for unauthorized access resulting from the User's negligence in protecting their password.

3.3. The User must immediately notify PayPosts upon becoming aware of any unauthorized use of their account.

3.4. Each account is personal and non-transferable. Sharing access credentials is prohibited, except where expressly permitted under the contracted plan.

6. Intellectual Property

6.1. The Platform, including its source code, design, brand, logo, text, graphics, algorithms, and other elements, is the exclusive property of PayPosts or its licensors, protected under Brazilian intellectual property law.

6.2. The User does not acquire, through these Terms, any ownership right over the Platform. Access is granted under a limited, non-exclusive, non-transferable, and revocable license.

6.3. Content created and published by the User through the Platform remains the User's property. By using the Platform, the User grants PayPosts a limited, non-exclusive license to process that content solely for the purpose of providing the contracted service.

6.4. Data and reports generated by the Platform based on publicly available information do not grant the User any exclusive rights over such information.


7. Service Availability and Modifications

7.1. PayPosts strives to keep the Platform continuously available but does not guarantee uninterrupted availability. The Platform may experience interruptions for maintenance, updates, or reasons beyond PayPosts' control.

7.2. PayPosts reserves the right to modify, suspend, or discontinue features of the Platform at any time, with reasonable prior notice when possible.

7.3. The Platform depends on third-party APIs and services (TikTok, Instagram). Changes to those APIs or platforms may affect PayPosts' features without constituting a breach of these Terms.


8. Limitation of Liability

8.1. PayPosts provides the Platform "as is." We do not guarantee that the results obtained through the Platform will be complete, accurate, or suitable for any specific purpose.

8.2. PayPosts is not liable for:

8.3. PayPosts' total liability, where applicable, will be limited to the amount actually paid by the User in the 12 (twelve) months preceding the event giving rise to the claim.


9. Plans, Payments, and Refunds

9.1. Access to the Platform may be offered under different plans, with distinct features and prices, as described on the Platform's pricing page.

9.2. Prices, payment methods, and conditions for each plan will be disclosed at the time of purchase.

9.3. The refund policy is governed by the conditions established for each plan and by applicable law, including Brazil's Consumer Protection Code where applicable.


10. Suspension and Termination

10.1. PayPosts may suspend or terminate the User's account at any time under the following circumstances:

10.3. Termination of the account does not release the User from obligations incurred during the period of use, including outstanding payments.

10.4. After termination, the User's data will be handled in accordance with PayPosts' Privacy Policy and applicable law.


11. Indemnification

The User agrees to indemnify and hold PayPosts, its directors, employees, and partners harmless from any claim, loss, damage, or expense (including attorneys' fees) arising from: (a) the User's breach of these Terms; (b) misuse of the Platform; or (c) the User's infringement of third-party rights.


12. Governing Law and Jurisdiction

12.1. These Terms are governed exclusively by the laws of the Federative Republic of Brazil.

12.2. The courts of São Paulo/SP are hereby elected, to the exclusion of any other, however privileged, to settle any disputes arising from these Terms.


13. General Provisions

13.1. If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.2. PayPosts' tolerance of any breach of these Terms by the User will not constitute a waiver of its right to demand compliance with the breached provision.

13.3. These Terms constitute the entire agreement between the User and PayPosts regarding use of the Platform, superseding any prior understandings on the same subject.
